A big companies do not pay Insurance Number

The Ministry of Labor of Costa Rica detected 2,664 companies or commercial establishments that do not insure their workers with either the Costa Rican Social Security Fund (CCSS) or with the National Insurance Institute (INS).

Businesses have a legal obligation to enroll their employees in the CCSS so that they have access to disability, ancient age and death insurance and in the INS so that they are covered in case some occupational hazard or accident should occur.

The lack of worker registration in the CCSS and INS were detected during the first months of the year during the sweeps carried out by Labor Ministry inspectors to verify compliance with those requirements as well as the payment of bonuses.

In total, inspectors visited 3,600 commercial establishments throughout the country.  Data were supplied by the head of the National Inspection Directorate of the Labor Ministry in Costa Rica, Rodrigo Acuña.  He said that establishments were chosen as indicators that show worker vulnerability.

The main factor was the size of the company.  According to Acuña, lack of compliance was more common in companies with fewer staff.

Of the 3,600 business establishments, 1,440 did not have worker insurance with the INS, while 1,224 did not report their payroll to the CCSS.  In some cases, Acuña said that some companies did not comply with both requirements.  

Manuel Rodriguez, president of the Union of Chambers and Private Enterprise (UCCAEP) in Costa Rica, said that the obligation to pay Christmas bonuses to all workers before December 20, and the obligation to insure the worker has been promoted among all the members.

“UCCAEP has helped strengthen labor inspection since this is the only institution responsible for ensuring compliance with existing labor legislation,” he noted Rodriguez.

Inspectors also detected 720 companies that did not pay a Christmas bonus to their workers, so they had a complaint filed against them in the Courts of Justice in Costa Rica.  Rodrigo Acuña said that in the face of the complaint, the majority of the workers received their bonus.

The penalty for those failing to pay the bonus can be from 11 to 13 base salaries or ¢2.5 million, approximately.  Labor minister Alvaro Gonzalez said that lack of compliance with the so-called monthly salary number 13 usually happens in companies with few workers in number 13 firms understaffed.

Gonzalez cited the example of domestic workers in Costa Rica.  ”The problem is that sometimes the employer lacks the resources to meet that payment, but that is no excuse, of course.”  

The bonus must be paid before December 20.  The Ministry of Labor expects to inspect more than 4,000 businesses this year.

These utah county home inspections and sanctions need to be executed on a more regular basis.  But, large companies should also be inspected because sometimes they fail to comply with labor laws too.
